All organizations can take steps to minimize risk in their employee benefit programs and better prepare employees for retirement by instituting internal controls maintained by qualified individuals, some of whom are fiduciaries to the plan.  Many plan fiduciaries underestimate their obligations, which can increase their risk for not meeting their fiduciary responsibilities, which in turn can adversely affect the plan. This session will provide you an overview of the information you need as a plan fiduciary or service provider to plans to facilitate effective governance and better guard against noncompliance with the applicable rules, which could expose you, your company, other plan fiduciaries and/or your clients to significant liabilities.

About Our Presenters:
 
Bill Warburton is the partner-in-charge of the Holthouse Carlin & Van Trigt LLP (HCVT) benefit plan audit practice, which annually performs over 250 plan audits. With over 30 years of experience, Bill has developed a very strong background auditing 401(k) and other benefit plans. Bill’s practice is dedicated solely the auditing of benefit plans. Bill is a member of the American Institute of Certified Public Accountants, the California Society of Certified Public Accountants, and the National Institute of Pension Administrators (NIPA). Bill also serves on the board of directors of the Los Angeles Chapter of NIPA. For fun, Bill has a private pilot’s license and competes in aerobatic competitions.
 
R. Bradford Huss “Brad” is a member of the San Francisco law firm of Trucker Huss, APC, which practices exclusively in the fields of ERISA and employee benefits. He concentrates his practice on qualified pension and profit sharing plans, ERISA litigation, fiduciary responsibility matters and Department of Labor investigations. He has spoken numerous times throughout the country on qualified plan and fiduciary responsibility matters and has testified before the United States Senate Finance Committee concerning retirement security issues. He is a charter fellow and a former member of the Board of Governors of the American College of Employee Benefits Counsel. Brad is a past member of the Board of Directors of the American Society of Pension Professionals & Actuaries, a former chair of the Employee Benefits Committee of the Section of Tort Trial and Insurance Practice of the American Bar Association and a past president of the San Francisco Chapter of the Western Pension & Benefits Council.
 
Nick White is special counsel with Trucker Huss, where he advises plan sponsors, fiduciaries and their service providers on ERISA and other employee benefits matters. Prior to entering private practice, Nick worked for the IRS in what is now known as the Tax Exempt & Government Entities Division, where he served on the Technical Review Staff. Ultimately, Nick became the coordinator of the IRS’ Western Region Walk-in Closing Agreement Program, which is now part of the Voluntary Correction Program. Nick is a fellow in the American College of Employee Benefits Counsel. He is a current member of the Government Affairs Committee of the American Society of Pension Professionals & Actuaries (ASPPA) and a past member of both the Executive Committee and the Board of Directors of ASPPA. Nick is also a current member of the Board of Directors of the LA Chapter of the Western Pension & Benefits Council. He frequently speaks at conferences held by ASPPA, the National Institute of Pension Administrators and other industry organizations. Nick served on the Editorial Advisory Board for Thompson Publishing Group and was the Contributing Editor of Thompson's Pension Plan Fix-it Handbook. He has also written on employee benefits topics for the Journal of Taxation, the Journal of Pension Benefits and other industry publications.
